Terms of Service

These terms govern your use of BrandPrompts (“the Service”), operated by BrandPrompts, a company registered in the United Arab Emirates (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to these terms. If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these terms.


1. What the Service does

BrandPrompts is a generative engine optimisation (GEO) monitoring platform. We help you understand how your brand appears in AI-powered search engines by:

  • Designing and managing sets of tracking prompts based on your brand, competitors, and target markets
  • Submitting those prompts to third-party AI search engines (including ChatGPT, Perplexity, Gemini, Claude, and others)
  • Collecting, analysing, and reporting on the responses those engines return
  • Providing visibility scores, competitive benchmarking, and research reports based on that data

The Service depends on third-party AI engines that we do not control. We describe what this means for you in Section 6.


2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.

You must notify us promptly if you become aware of any unauthorised access to your account. We are not liable for losses arising from unauthorised use of your credentials where you have failed to keep them secure.

You must be at least 18 years old to use the Service.


3. Plans and payment

One-off purchases

All BrandPrompts plans are one-off purchases at fixed prices. You are billed once at the time of purchase and receive immediate access to your plan's features and limits. There are no recurring charges or automatic renewals.

Refunds

Purchases are non-refundable once delivery of research or prompt generation has begun. If you experience a technical issue that prevents delivery, contact us and we will work to resolve it or issue a refund at our discretion.

Price changes

We may change plan prices at any time. Price changes do not affect purchases already completed.

Failed payments

If a payment fails, we will attempt to process it again and notify you. If payment remains unsuccessful after 7 days, we may suspend your access until the balance is resolved.


4. Your data and intellectual property

You own your data

You retain full ownership of all data you provide to the Service, including brand names, keywords, competitor lists, prompt configurations, and any other content you input (“Your Data”).

You grant us a licence to operate

By using the Service, you grant us a limited, non-exclusive, worldwide licence to use, process, store, and transmit Your Data solely for the purpose of providing and improving the Service. This licence terminates when your data is deleted.

Reports and outputs

Research reports, visibility scores, prompt research documents, and other outputs generated by the Service (“Outputs”) are delivered to you and are yours to use. We retain a non-exclusive licence to use anonymised and aggregated Output data for product improvement and benchmarking purposes.

We own the platform

The Service itself — including its software, algorithms, methodology, prompt design frameworks, user interface, and documentation — is and remains our intellectual property.


5. Acceptable use

You agree not to:

  • Use the Service to monitor brands you do not have a legitimate business reason to track
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use automated tools to scrape or bulk-extract data beyond what your plan permits
  • Resell or redistribute the Service without our written consent
  • Use the Service in any way that violates applicable law or third-party rights
  • Interfere with or disrupt the Service

6. Third-party AI engines

How the Service works

To measure brand visibility, we submit tracking prompts to third-party AI search engines on your behalf. This is a core function of the Service.

What this means

  • Prompts may contain your brand name, competitor names, and category-related keywords
  • Once submitted, the third-party provider's terms and data handling practices apply
  • AI engine providers may change their behaviour, terms, or availability at any time

What we do not control

  • The content, accuracy, or completeness of AI engine responses
  • Whether or how an AI engine mentions your brand
  • Changes to AI engine algorithms or training data
  • Temporary or permanent unavailability of any AI engine

7. Availability and support

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We provide support via email. Response times vary by plan.


8. Limitation of liability

We provide the Service “as is” and “as available.” We make no warranties regarding fitness for purpose, accuracy, or reliability.

Our total liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, or data; decisions made based on AI visibility data; actions of third-party AI providers; or loss from failure to secure your account.


9. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service in violation of these terms, your data infringing third-party rights, or your breach of applicable law.


10. Term and termination

By you: You may cancel at any time. Cancellation takes effect at the end of your billing cycle.

By us: We may suspend or terminate access for breach of terms, inactivity over 12 months, or legal requirement.

Effect: Your Data will be available for export for 30 days after termination, then permanently deleted.


11. Changes to these terms

We may update these terms with at least 30 days' notice. Continued use constitutes acceptance.


12. Governing law and disputes

These terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of UAE courts. Both parties agree to attempt good-faith resolution for at least 30 days before formal proceedings.


13. General

  • Entire agreement. These terms and our Privacy Policy constitute the entire agreement.
  • Severability. Unenforceable provisions do not affect the remainder.
  • No waiver. Failure to enforce a right does not waive it.
  • Assignment. You may not assign without consent. We may assign in connection with a merger or acquisition.
  • Force majeure. We are not liable for delays caused by circumstances beyond our reasonable control.
